SECTION 1031 ALLOWS TAX DEFERRAL.
Section 1031 of the Internal Revenue Code enables investors in qualifying real property and business equipment that is 'used in a trade or business, or held for investment,' to defer the capital gains tax relating to the sale of their property when they acquire qualifying 'like-kind' property and observe other IRS guidelines.
Selling investment real property and personal property (such as aircraft and business equipment) for a gain results in a capital gains tax liability. Section 1031 Exchanges enable investors to trade-up to newer or larger assets without adverse tax consequence. Capital is preserved and efficently redeployed.
QUALIFIED INTERMEDIARY.
A 'Qualified Intermediary' is required to facilitate the transaction. Under theSection 1031 rules, your exchange funds must be held in an account established by the Qualified Intermediary.
